What Personal Data We Collect and Why We Collect It

When visitors leave comments on the site, we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. Since we don’t currently have any advertising or marketing on our website, PQ Media does not have any partnership with a third-party vendor to share your contact information.

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What Rights You Have Over Your Data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Credit Card Information Collected Through Website

PQ Media does not collect nor retain any credit card information. The Payments are not stored on the PQ Media website or on the PQ Media web server. Our e-commerce platform is hosted by Stripe that allows us to sell our syndicated reports to you. Access to PQ Media Syndicated Reports

We reserve the right, but are not obligated, to limit the sales of our Reports to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by resellers or distributors.

Executive Summary Download and/or Single-User License

The following Terms & Conditions of Use (the “Terms”) apply to any Executive Summary download or to the purchaser of a single-user license (the “Licensee”) who is the only end user permitted to use a PQ Media syndicated “Report”, such as the PQ Media’s Global Advertising & Marketing Revenue Forecast 2018-22, as well as all the data, analysis, information, charts, graphs and other content in the Report (collectively known as the “Content”), provided that Licensee meets the conditions set forth in the Permitted Use section below. PQ Media expects the Licensee to treat the Report in the same way he/she would treat any print, digital, hybrid or other media product or service (ex., book, software, information service) that is licensed from a third-party creator, publisher, developer, producer or content owner. Accordingly, please read these Terms carefully before using this Report. 

Permitted Use – The Licensee may use Content from the Report solely for Licensee’s internal business purposes as set forth in this section. To make a Permitted Use, the Licensee may transfer the core PDF report or companion Excel databook to a computer under Licensee’s exclusive control and he/she may display a digital copy or print a hard copy of the Report for his/her internal business purposes. Such purposes may include the use of summary or excerpted Content from the Report in a presentation made to clients employed at external organizations or in a presentation made to media industry executives at a business trade show, provided that any summary use of Content from the Report appropriately cites “PQ Media” as the sole source and copyright owner of the Content, and that PQ Media’s proprietary logo(s) are prominently and properly displayed in the same form(s) as they appear in the original(s). 

Prohibited Use – The Licensee is not permitted to use, copy, print, email, distribute or share with any other individual or entity the Report or any Content in the Report in any form or manner other than the Permitted Uses described in the preceding section. If Licensee would like to use or share the Report or any of its Content in a manner that diverges from the specific uses described in the Permitted Use section, Licensee must contact PQ Media to execute an upgrade to his/her single-user license to a multi-user license. In addition, the Licensee is prohibited from publishing the full Report or its Content in partial form on a companywide intranet or other similar multi-user or enterprise-wide information service or through any print, digital, hybrid or other publishing system now in existence or developed hereafter. Licensee is not permitted to modify or re-work the Report or its Content in any way, and he/she is prohibited from selling, leasing, renting or sub-licensing the Report in any manner. 

Rights – The Licensee is granted the nonexclusive, non-transferable right to store and use the Report in print or digital format for internal business purposes as described in the Permitted Use section above, and this right to “use the Report” is strictly limited to the authorized uses detailed therein. PQ Media reserves all rights not expressly granted to Licensee in these Terms. Without limiting the generality of the foregoing, the Licensee acknowledges and agrees that except as specifically set forth in this paragraph, PQ Media retains all right, title and interest to the Report and all its Content, as well as all other related materials and assets described in the section that follows.  

PQ Media’s Copyright & Intellectual Property – The Report and all its Content therein is owned solely by PQ Media, including the exclusive copyright, and the Licensee acquires no ownership rights whatsoever. Any use by Licensee other than expressly permitted in these Terms is strictly forbidden. The Licensee hereby acknowledges and agrees that PQ Media does now and shall in perpetuity own all right, title and interest (including all copyright and intellectual property rights) in and to the Report and all its Content, as well as the related research methodologies, databases, datasets, market research and support materials, sources, opinion leader panels, analysis, charts, graphs, tables, algorithms, forecasts and projections, notes, and any other materials and assets created by PQ Media for the Report. 

Information “As Is” – All information and data contained in the Report are obtained by PQ Media from sources that PQ Media believes to be accurate and reliable. However, errors and omissions in the Report may result from human error, technical malfunctions, electronic or digital conversion glitches and/or transmission of textual and numeric data.

Multi-User License

The following Terms & Conditions of Use (the “Terms”) apply to the purchaser of the multi-user license (the “Licensee”) and all End Users within the Licensee’s organization (the “Users”) that meet the conditions described in the Permitted Use section below for any PQ Media syndicated “Report,” such as the PQ Media’s Global Advertising & Marketing Revenue Forecast 2018-22, which includes all content, data, analysis, information, charts, graphs, research methodologies, algorithms, databases, datasets, market research, support materials, notes, sources, opinion leader panels, forecasts, and any other related materials and assets created by PQ Media and/or included in the Report by PQ Media (collectively known as “Content”).

PQ Media expects the Licensee and Users to treat the Report and all Content therein in the same way you would treat any print, digital, hybrid or other media product or service (ex., book, software, information service) that is licensed from a third-party creator, publisher, developer, producer or content owner. Accordingly, please read these Terms carefully before using this Report in any manner. 

Permitted Use – The Licensee and the Users within the Licensee’s organization may use the Content from the Report solely for Licensee’s or User’s internal business purposes as set forth in this section. Examples of such Parties include, but are not limited to, full-time and part-time employees, independent contractors, management consultants, corporate partners, board members and clients, as well as public corporations, private companies, management consulting firms, financial institutions, trade associations, educational organizations and advertising agencies. If Licensee would like to use or share the Report or any of its Content in a manner that diverges from the Permitted Uses detailed in the section above, the Licensee must contact PQ Media to either request written permission for an unauthorized use or to purchase an upgrade to his/her current end-user license to allow for such a use. Licensee is not permitted to modify or re-work the Report or its Content in any way, and he/she is prohibited from selling, leasing, renting or sub-licensing the Report in any manner.

The following Terms & Conditions of Use (the “Terms”) apply to the purchaser of the special enterprise bundle license (the “Licensee”) and all End Users within the Licensee’s organization (the “Users”) that meet the conditions described in the Permitted Use section below for PQ Media’s Global Media & Technology Forecast Series (the “Series”), which includes three (3) individual reports (the “Reports”) and all content, data, analysis, information, charts, graphs, research methodologies, algorithms, databases, datasets, market research, support materials, notes, sources, opinion leader panels, forecasts, and any other related materials and assets created by or included by PQ Media in the Series and the Reports therein (collectively known as “Content”). The titles of the three Reports included are as follows:

  • Global Advertising & Marketing Revenue Forecast
  • Global Consumer Media Usages & Exposure Forecast
  • Global Consumer Spending on Media Content & Technology Forecast

PQ Media expects the Licensee and Users to treat the Series, Reports and all Content therein in the same way you would treat any print, digital, hybrid or other media product or service (ex., book, software, information service) that is licensed from a third-party creator, publisher, developer, producer or content owner. Accordingly, please read these Terms carefully before using the Series or any of the three Reports therein.

How We Protect Your Data

This site is secure using an up-to-date SSL. The site is hosted by WPEngine, which is the most secure server for this type of website. Strong passwords are enforced.

Industry Regulatory Disclosure Requirements

PQ Media is not a member of any regulated industry. Clients that are in regulated industries, such as public media companies, financial institutions and consulting services, can contact PQ Media if there are any issues over the contact information we collect that need to be reported to those industry regulators.

Indemnification & Severability

You agree to indemnify, defend and hold harmless PQ Media and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms & Conditions of Use or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms & Conditions of Use is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions of Use, such determination shall not affect the validity and enforceability of any other remaining provisions.

Entire Agreement, Changes to the Terms & Governing Law

The failure of us to exercise or enforce any right or provision of these Terms & Conditions of Use shall not constitute a waiver of such right or provision.
